Terms of Service

Final Quote Guarantee

The quote provided to you upon booking is the final quote for your shipment. There will be no additional costs, hidden fees, or surprise charges. The total amount quoted includes all applicable costs for the transport of your vehicle, as agreed upon at the time of booking.

Agreement to Dispatch

By signing this agreement, the customer authorizes Bigfella Auto Express to list the vehicle for dispatch on nationwide carrier boards to secure a transport carrier.

Vehicle Condition

Customers must provide accurate and complete information about the vehicle being transported, including its operability. If a vehicle is inoperable or has been misrepresented, additional fees may apply. Customers are responsible for ensuring that any toll devices are deactivated before transport to avoid incurring toll charges.

Pickup and Delivery Windows

Bigfella Auto Express and its assigned carriers will make every effort to meet the estimated pickup and delivery windows provided at the time of booking. However, these estimates are subject to factors beyond our control, including but not limited to traffic, weather, mechanical issues, or other unforeseen delays. Compensation for delays may be offered on a case-by-case basis, depending on the circumstances and the level of inconvenience caused.

Customer Responsibilities

Customers are responsible for preparing their vehicle for transport. This includes:

  • Removing personal belongings: Vehicles must be free of any personal items before transport. Bigfella Auto Express and its carriers are not liable for any personal property left in the vehicle.
  • Providing accurate contact information: The customer must provide correct contact details for both the pickup and delivery locations.
  • Ensuring presence at pickup/delivery: The customer or a designated representative must be present at both pickup and delivery to inspect the vehicle and sign the Bill of Lading. Failure to do so may result in delays or additional charges.

Dispatch and Payment Terms

  • The customer agrees to sign this contract to authorize Bigfella Auto Express to list their vehicle for dispatch.
  • A deposit payment is required upfront prior to dispatch for the carrier to be assigned to the transport. The remaining balance is due upon delivery and must be paid via Zelle or cash.

Insurance and Liability

All vehicles transported by Bigfella Auto Express are covered under the carrier’s insurance, which is verified prior to dispatch. The minimum coverage required for all carriers is $100,000 in cargo insurance. In the event of damage during transport:

  • The customer must report damage immediately upon delivery.
  • Bigfella Auto Express will assist with the claims process but is not responsible for damages covered under the carrier’s insurance policy.
  • Additional insurance for high-value or custom vehicles is available upon request.

Cargo Insurance Coverage

Cargo insurance is provided by the carrier to cover specific risks while the vehicle is in transit.

What Cargo Insurance Typically Covers:

  • Damage to the vehicle during transit caused by accidents or external factors (e.g., collisions, fire, theft).
  • Repairs for damage incurred while the vehicle is in the carrier's possession during transit.
  • Replacement costs for a vehicle if deemed a total loss during transport.
  • Theft of the vehicle during transit.

What Cargo Insurance Does Not Typically Cover:

  • Pre-existing damage to the vehicle (including scratches, dents, and rust).
  • Personal items or belongings left inside the vehicle.
  • Damage caused by acts of nature (e.g., hail, floods, earthquakes) unless specifically covered in the carrier's policy.
  • Damage to glass, such as windshields, windows, or mirrors, caused by rocks or road debris during transit.
  • Mechanical or electrical failures unrelated to external damage during transport.
  • Damage incurred during loading or unloading, unless explicitly covered in the carrier’s insurance policy.
  • Delays or loss of use of the vehicle (e.g., rental car expenses due to late delivery).

Carrier Liability Coverage

Carrier liability insurance provides protection for damages or injuries caused by the carrier’s truck or trailer during the transport process.

What Carrier Liability Insurance Typically Covers:

  • Damage to other vehicles or property caused by the carrier’s truck (e.g., collisions involving another vehicle or structure).
  • Bodily injury to third parties caused by the carrier’s truck during operations.
  • Legal defense costs for claims resulting from accidents involving the carrier’s truck.
  • Costs associated with environmental cleanup, such as fuel spills, caused by an accident during transport.

What Carrier Liability Insurance Does Not Typically Cover:

  • Damage to the vehicle being transported (this is covered under cargo insurance).
  • Damage to personal items or belongings left inside the transported vehicle.
  • Mechanical or operational failures of the carrier’s truck or trailer.
  • Damage caused by acts of nature (e.g., hail, floods) unless explicitly covered in the carrier’s policy.

Cancellation Policy

  • If you cancel after a carrier has been assigned, $150 cancellation fee will be charged to cover administrative and operational expenses.
  • There is no fee to cancel prior to carrier assignment and dispatch.

Force Majeure

Bigfella Auto Express is not liable for delays or failures to perform caused by events beyond our control, including but not limited to natural disasters, accidents, strikes, acts of terrorism, or government actions. In such cases, reasonable efforts will be made to resume service as soon as possible.

Limitation of Liability

Bigfella Auto Express is not liable for any indirect, incidental, or consequential damages resulting from delays, vehicle damage, or unforeseen events during transport. Our liability is limited to assisting with the claims process for damages covered under the carrier’s insurance policy.

Dispute Resolution

In the event of a dispute, both parties agree to resolve the matter through mediation or arbitration before pursuing litigation. Any legal action must be filed in the state of Texas, and Texas law shall govern this agreement.

Additional Standard Terms

  • Privacy Clause: Bigfella Auto Express will handle customer data with confidentiality and only use it for the purposes of fulfilling the transport agreement.
  • Compliance Statement: The customer agrees to comply with all local, state, and federal laws regarding vehicle transport.
  • Entire Agreement: This contract represents the full understanding between the customer and Bigfella Auto Express. No other agreements, written or oral, are valid unless appended to this contract in writing and signed by both parties.
